Overview

The protection of personal information and compliance with privacy and data protection laws and regulations are of great value to us. We understand that failure to adequately address privacy risks and comply with relevant laws can cause brand and reputational damage and as well incur legal penalties against defaulting individuals or organisations. We are committed to enforcing this Policy.  Any failure to comply with this Policy may constitute a breach of the terms of being a member of staff of Mahayogi Siddhababa Spiritual Academy (hereinafter referred to as the Academy) and may as well attract disciplinary actions, which may include but not limited to termination of services rendered by a member of staff of the Academy. 

Senior management of Nepal, which is ultimately responsible for ensuring adherence to this Policy and any breach thereof, will be heard in the court of Nepal unless relevant countries’ laws and regulations have exceptions as regards to such being heard in the court of Nepal. 

The protection of your personal data and or sensitive data is fundamental to preserving your trust.  In a similar vein, personal data used responsibly can create substantial business opportunities for us with corresponding benefits for concerned individuals.  

This Policy which involves the processing of personal and sensitive data, applies to individuals who deal with the Academy, as well as members of staff of the Academy. Total compliance to this Policy is expected across all the branches of the Academy around the world. It is your responsibility, and that of every member of staff of the Academy, to comply with provisions of this Policy. Acknowledgement and working understanding of this Policy are required, and are effected in various ways, including through contractual agreements and selecting the options available in the Academy`s advertised services either on the website or in other forms such as pamphlets advertised outside the website(s) of the Academy. 

Our website(s) contain(s) links to other sites. We are not responsible for the Copyrights Information and Privacy Policy practices or the content of those sites. Our Copyright information is included in this Policy. You are prohibited from misuse or alteration of information collected through this website(s).

Definitions

  • “a Service Provider”/ “We” / “Us” means the head office of the Acadamy in Nepal and its branches located in various countries, including the United Kingdom (UK), the United States of America (USA), Australia, and Canada.  
  • “Services” means services rendered via the Academy’s website or in any other place, for example, services leaflets, et cetera. 
  • “You” / “Visitor” means any individual or person who visits the Academy’s website(s) for any purpose such as information collection, payment, research, copying, updating, referencing, enquiring for a new product and services. 
  • “Staff” means any individual or person or a group of persons responsible for running the Acadamy, and also includes anyone who is directly or indirectly responsible for operations of the Academy globally, serving as volunteer or a paid employee.  
  • “Personal data” is data which relates to an identifiable living person (“data subject”)
  • “Sensitive data” is any data that reveals racial or ethnic origin or any other information of a similar category.

You agree that you will not use the trademark or name of the Academy in connection with your products, services or business for commercial uses. You agree that you may be entitled to make limited copies of information on this website(s) for private purposes only. You may not use or reproduce any copyrighted material on this website(s) for any other purpose without Mahayogi Siddhababa Spiritual Academy’ written consent. 

Unless otherwise stated, the copyright in all materials displayed on this website(s) is owned by Mahayogi Siddhababa Spiritual Academy used under licence or royalty free.

Types of Information We Collect

  • Personal Data” means any information relating to an individual that identifies the individual or which could reasonably be used to identify such an individual regardless of the medium involved (e.g. paper, electronic, video, audio). Examples of personal data include contact details, financial data, passwords, Internet protocol (IP) addresses, pictures, online search history, geolocation information. Unless otherwise stated, personal data is intended to include sensitive data (as defined in this Policy). 
  • Sensitive Data”  means information about the racial or ethnic origin, political opinions, religious or cultural beliefs, trade union membership, physical or mental health or condition, sexual orientation, genetic and biometric data (e.g. fingerprints, facial recognition, retinal scans), and criminal offences committed or alleged to have been committed by the data subject or any other information in the category so mentioned. 
  • “Personal Health Information” means any data relating to a person’s medical history or to their physical and mental health, including symptoms, and medical procedures.
  • “Payment Information” means an individual’s bank account information, credit card information or any other payment information that may include any of the combination of an expiration date, card verification value (CVV) code, and billing address. This information is only for one-time processing (we do not store payment information) necessary to provide services for visitors, such as making a donation and enrollments for services. The payment services may be provided by an authorised third-party service provider who complies with relevant payment regulations, otherwise, the Acadamy only uses such information at the time of payment.
  • “Internet Protocol (IP) Address” means a unique address that identifies a device on the internet or a local network. Browsing our website(s) with your device is only possible when your device has the automatically assigned IP address by your Internet service provider. Such an IP address and other relevant information may be identified and logged in our system or our third-party tools. When you access our website(s), we automatically collect certain information from your device, including your web browser name, time zone, and cookies installed on your device.
  • “Cookies” means a small piece of data stored on a visitor’s device by the web browser while browsing our website. Cookies are designed to be a reliable mechanism for websites to remember sessions` information or to record the visitor’s browsing activity. We aim to utilise the cookies information to provide a better service for visitors. Visitors provide their voluntary consents for the collection of cookies by us through our website.
  • “Access Control” is a method of guaranteeing the identity of the visitors (i.e., visitors are who they say they are) and that they have the appropriate access to the website. We may use single sign-on services offered by our third-party companies where visitors are no longer required to re-type their credentials multiple times when accessing their subscribed services via our website. Access Control may have a profile of a visitor that includes their user data, user authentication data, user consent and user profile management. 
  • “Other Information” means any information that is not captured in any of the aforementioned points. Wherever our website is hosted, the website host server does not collect information automatically like an e-mail address unless a visitor implicitly authorises us to submit its information via electronic form. When a visitor accesses our website and its contents, certain information is automatically collected by our website host server. Such information is not used for commercial or any other purposes but for internal review in order to improve the content and layout of our website. Such information also helps an individual visitor to offer customised content and or layout of the website and to notify visitors about updates on our website(s).

Your data will be processed to support the rendered services that can be found on our official website(s). All the services may not be listed on the official website(s) of the Academy. Other services can be obtained, but not only from the contact address listed in this Policy or from the contact address of any of the branches of the Academy. The Acadamy in Nepal and its branches located in various countries process data in accordance with all applicable laws and regulations relating to Processing of Personal Data and Privacy. 

Why We Collect the Information

We process personal and sensitive personal data to support the rendered services on our official website(s) and other digital and print media to effectively serve our visitors.  Major services to our visitors include the following:

  • Offering services provided on our official websites
  • Offering services locally advertised by Mahayogi Siddhababa Spiritual Academy
    branches outside the official websites 
  • Facilitating visitors to make a payment on the provided services
  • Provision of awareness about upcoming events 
  • Provision of  awareness of services on special occasions such as birthday and religious festival
  • Improving products and services for visitors
  • Communication of  administration related messages to visitors   

We do not mandate the collection of information, but it is voluntarily provided.

How We Collect the Information

  • “The websites” may contain a number of services such as enrollment of courses, signing up for webinar sessions, subscriptions to our newsletter, audio download, and video download. 
  • “Chat room” may provide various support for visitors, such as having queries while browsing the websites and having access to the chat room for querying a particular course. 
  • “Phone call” may be available for you to respond to your queries, such as when you have planned to attend one of our events where our support team provides you with assistance.
  • “Contact us” option on the website may provide link to a form that has a number of fields where you may provide your information.
  • “Offline form” that aims to assist you for a variety of reasons such as enrolment of the course, and technical support. The form may be available throughout the Academy around the world. 
  • “With your consent,” allows us to collect the information with your full consent. 
  • “Marketing” is a purpose which benefits us to attract visitors in various ways. For marketing, we, including our marketing and analytical vendors, may use your information (IP address, cookies, etc.), if voluntarily provided, to find your location, or your browsing activities to target interested age groups, etc. Marketing information can only personally identify you or any other user of the websites when such information is combined with your personal information. Personally identifying information is used for marketing purpose, only if it is provided voluntarily, whether in a digital form or in print.
  • “Obtain information from third-party vendors” might be utilised to enhance target marketing.
  • “Browser or Device” collects certain information (e.g. screen resolution, operating system name and version, internet browser name and version), which may be automatically sent to us from your browser or device.
  • “Web-based application” may be launched when you browse our websites. The application is used to collect certain information that may be used to track and collect usage data, such as when your device accesses our application. 
  • “Mobile application” that runs on various platforms such as Android and iPhone, developed by the Academy or its third party. Such applications may collect certain information that may be used to track and collect usage data, such as when your device accesses our website(s).
  • “Links” have been incorporated in the website(s) as well as other areas such as social media sites, e-mail, and blogs to understand your interactions across our services. 
  • “Cookies” are data files that are placed on your device or computer and often include a unique anonymous identifier. Data stored in cookies is created by our server upon your connection. Intended uses of cookies are to manage sessions between your device and our server, personalising the advertisement for you, and tracking your previous views of our products and services in our website(s).
  • “Third-party tools” are tools, platforms, or environments, or functionality developed by a party other than the Academy accessible through our website(s). Such tools offer services such as a collaboration application (e.g. Zoom), Newsletter signup, Twitter, and Facebook.  
  • “Aggregation of personal information” may be used to provide various information such as the percentage of our users who have visited our websites. 

We Follow the Data Protection Principles

The Academy’s operations shall at all times be consistent with our data protection principles set out below. “Our data” refers to any data but not limited to personal data, sensitive data, and personal health information collected by us or by a third-party provider digitally or in print. Third-party must commit to following our Data Protection Principles. These principles are binding across the head office of the Acadamy in Nepal and its branches located throughout the world, including the UK, USA, Australia, and Canada.  

  • Lawful, fair and transparent processing: we only use data in a way that is lawful, fair and transparent.
  • Purpose limitation: we only collect data for specified, clear and legitimate purposes and we only collect as much data as we need to achieve those purposes. 
  • Data accuracy: we take steps to ensure that the data we hold is accurate, up-to-date and relevant for the purposes for which it is collected. 
  • Data retention: we only keep data in an identifiable form for as long as is necessary for the purposes for which we are using it. 
  • Rights of the individuals: we are fully committed to addressing the privacy rights of individuals with respect to our processing of the data, in accordance with applicable laws. 
  • Information security: we use appropriate technical and organisational measures to keep data secure and ensure its integrity, confidentiality and availability across all systems at all times. 
  • International transfers of data: The Academy operates globally and, as such, we are required to transfer information internationally. We are fully committed to ensuring that there are adequate safeguards in place, as required by applicable laws, to protect the personal data we transfer to countries that do not have adequate data protection laws. 
  • Data protection accountability: In order to create an environment of trust and to comply with applicable laws, all individuals operating within or on behalf of the Acadamy must comply with this Policy and help uphold our commitment to the protection of data of individuals. 

We Respect Your Privacy

We collect and store your personal information. You may send a request to us at the contact address listed in this Policy if you would like to access, correct, amend, remove or limit the use or disclosure of any information about you. We may consider and respond to your request with respect to applicable laws. Your request may only be handled, if you provide your verifiable e-mail address and it is relevant to your personal information. We are committed to responding to your request within 45 days. We also provide you with an option not to disclose your information with us. However, this may restrict our potential services to you.  

We always provide you with an option not to receive marketing messages via e-mail, by post, or any other methods from us. You may request us at the contact address listed in this Policy to opt-out of receiving any marketing messages, but you may still receive administrative messages. We request you to be specific when you are opting out of marketing messages.

Complaint(s) and Compliment(s)

We welcome your constructive criticisms that will help us improve our services. A complaint can be made at the contact address listed in this Policy by any individual about the services that an individual has received from the Acadamy or its branches. You may wish to notify us if you are not satisfied with the way you have been treated or as regards to the quality of services you have received. We are committed to responding to your request within 45 days.
