Acceptance of Terms and Conditions of Use

Siddha Mahayog Spiritual Academy (hereinafter referred to as “the Academy”) has issued this notice on this Website.

Your access to this Website is subject to these general terms and conditions (the “Agreement”) of use. Carefully read all the Agreement of use before proceeding. Accessing this Website is the equivalent of your authorized signature and indicates your acceptance of the Agreement and that you intend to be legally bound by it. If you do not agree to the Agreement, please do not use this Website and do not enquire about any products and/or services offered from this Website or described on this Website.

The Academy may advertise its products and/or services on individual branches’ official Website(s). Such products and/or services may be advertised in paper or in any other form outside the Academy’s official Website(s). Where applicable, you may be presented with a facility in a way to capture your consent, to evidence your acceptance of this Agreement before you proceed to access the Academy’s Website(s) and/or order the Academy’s products and/or services.

You must accept the Academy’s recent Privacy Policy published on this Website before your acceptance of this Agreement. Therefore, carefully read the Policy before proceeding. Without accepting both the Privacy Policy and the Agreement, which constitute a legally binding agreement between you and the Academy, please do not use this Website and do not enquire about any products and/or services offered from this Website or described on this Website, or in paper.

Many definitions that are included in the Privacy Policy can be highly useful in understanding this Agreement. Amendment of Terms and Conditions of Use

The Academy reserves the right in its sole discretion to amend the Agreement for any reason at any time. Any and all such amendments will be effective from the date they are published and will apply to all access for continued use of this Website. Such amendments will be effective on any products and/or services offered on this Website or in paper.

By continuing to use or access the Academy’s Website(s) and the products and/or services offered by the Academy on this Website or in paper, you agree to be bound by the Agreement as amended, regardless of whether or not the Academy notified you of such amendments. It is your responsibility to periodically review this Agreement for the awareness of any amendment(s). No changes to the Agreement are valid or will have any effect unless agreed to by the Academy in writing.

Any credentials (refer to the combination of username and password and also to other mechanisms to identify a user) created by you through this Website(s) are confidential which you must keep in a secure place either by utilising a password manager or in such a way that such credentials are not disclosed to any other person or entity;
You will follow industry-standard best practices and the Academy security procedures, where applicable, when creating a password for your account;
You will notify the Academy immediately of any unauthorised access to or use of your credentials which could be your username and/or your password, or any other breach of security; and
You will not transfer your account, if any, to another person without the prior written consent of the Academy.

There may be products and/or services offered by the Academy in other forms such as in paper, which might be advertised outside the Academy’s Website(s). Any products and/or services advertised in other forms may have a volunteering option to accept this Agreement, in which case you accept the Privacy Policy and the Agreement advertised on the Website(s).

Your Acceptance of the Products and/or Services Outside of the Website(s)

The Academy consists of several branches worldwide, including Nepal, United Kingdom, USA, Australia, and Canada, which may offer the products and/or services in paper that are locally or regionally specific to such countries. Such offer(s) may or may not be advertised on the Website(s). Nevertheless, any exception to this Agreement, or acceptance of this Agreement is clearly notified to you, if applicable, for you to make an informed decision whether to accept the Privacy Policy and the Agreement.

The Academy’s Website(s) may contain blogs, or other way(s) of submitting, posting, publishing, displaying, or otherwise transmitting content, material, or information to the Website(s) or to other users or persons through or using the Website(s).

You may purchase products and/or services on the Academy’s Website(s) or in paper. Your purchase will be subject to this Agreement and any additional terms relating to a particular product and/or service.

Method of Payment

With your provided method of payment, and completing the steps required of you during the check-out process, you can place an order for a product on the Website(s). All information provided by you to the Academy during the check-out process must be truthful, accurate, and complete for the purposes for which such information was requested. By providing payment information to the Academy, you represent and warrant that you are the authorised owner of such payment method.

You may select other way of making the payments, the details of which may be made available to you in paper where the products and/or services are advertised outside the Website(s).

You may receive an email or a telephone call confirming that such an order has been received by the Academy. However, the company reserves the right at its sole discretion, to accept or reject any order confirmation provided to you that does not constitute an acceptance of your order prior to delivery of such an order.

The Academy will respect any legal rights you have with respect to your order under applicable consumer protection laws.

Refund or Cancellation of Products and/or Services

The Academy does not represent or warrant that any products and/or services description, image, or other such content(s) on its Website(s), or in paper, is accurate, complete, reliable, or current. If you deem that the products and/or services you purchased on the Website(s) or by any other medium from any of the Academy’s branches are not as described on the Website(s) or in paper, your sole recourse is to refer such products and/or services to the Academy for a refund or cancellation. Additional terms relating to refund and cancellation contained on the platforms or media of such products and/or services must be complied with. To the extent legally permissible, the only warranties and conditions provided to you with respect to any particular products and services are those warranties and conditions expressly described on the Website(s) or in paper.

Intellectual Property Laws

You agree to comply with the Academy’s recent Privacy Policy. Such Policy includes information for compliance to copyright and trademark information. Any content(s) generated by you as explained in this Agreement, are not subject to the Academy’s copyright terms.

Enforcement of the Agreement

The Academy may in its sole discretion for any or no reason, with or without notice, and at any time terminate the Agreement of use. The Academy may also limit, suspend, or terminate your access to or use of the Website(s). Your access may be prevented from using the Website(s) when there are technical or any legal steps to be followed. Any content(s) generated by you may be removed or modified without any prior notice.

Any such termination or action by the Academy shall be in addition to and without prejudice to such rights and remedies as may be available to the Academy, including injunction and equitable remedies. Any terms of the Agreement of use which are necessary to give effect to the rights of the Academy under this Agreement or that contemplate survival beyond termination shall survive, except to the extent not permitted by law. To the maximum extent permitted by applicable law, you agree at all times to indemnify, defend, and hold harmless the Academy and you agree not to proceed with any claims, actions, proceedings, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including legal and other fees and disbursements) sustained, incurred, or paid by the Academy, or arising out of or relating to your breach of the Agreement of use or your access or use of the Website(s).

Limitations on Liability and Disclaimer

You acknowledge that you are solely and entirely responsible for your use of the Website(s) and your computer, internet, and data security.

The Academy is not responsible for any content(s) on the Website(s), which may include but not limited to:

Any changes the Academy may make to the Website(s) or to any content on the Website(s), or for any permanent or temporary cessation in the provision of the Website(s) or any content on the Website(s).

Student/User Code of Conduct

The Academy’s Student Code of Conduct (hereinafter referred to as CoC) refers to a collection of rules and regulations stipulating the minimum ethical conducts and responsibilities expected of students of the Academy. The CoC governs the students’ activities and behaviour which can bring negative consequences if not properly put in check in the Academy’s premises or elsewhere.

When you purchase a course that is categorized under items of products or services, you may be qualified as a student. As a student, you must adhere to the Code of Conduct (CoC) of the Academy. The CoC may be included at the time of ordering the course.

Students are members of the Academy and are as such expected to act responsibly, respect others and safeguard properties belonging to the Academy. Where there is a reasonable cause to believe that a student has broken the CoC, or that their behaviour does not meet the Academy’s requisite standard, such violation may be construed as a breach of the CoC, and thus, attract disciplinary actions to defaulting student. Such disciplinary actions may include but not limited to termination of the student’s course. Furthermore, there may not be any refund available to student who has been found to have violated the CoC of the Academy. Any student who has been found guilty of violating the CoC of the Academy reserves the right of an appeal. An appeal is a request for the decision to be changed, which may only be considered where the student can prove that some specified reasons within CoC are in their favour.

It is the student’s responsibility to fully understand and comply with the CoC including all the terms and conditions included in this Agreement.

General Question(s) and Complaint(s) Procedure

A question or a complaint related to this Agreement can be made at the contact address listed under this Agreement by any individual about the products and/or services such an individual is about to receive or has received from any branches of the Academy.

You may wish to lodge a complaint if you are not satisfied with the interpersonal interactions with any of the Academy staff or as regards the quality of services you have received. Complaint(s) can either be made via e-mail or by post at the address provided in this document as soon as you encounter a complaint-triggering issue. You must include your contact details which include: your name, contact address, telephone number and e-mail address, so that we can contact you and assist in following the steps to resolve the issue and, where necessary, escalating a complaint to your service provider from where your order was made for the Academy’s products and/or services. You should provide the details of your complaint in relation to the regulations and expectations of the Academy.. If applicable, the complaint should accompany evidence to support the said complaint. Additional terms relating to the complaint procedures may be made available to you at or before your time of ordering the products and/or services either in paper or through the Website(s).The Academy will acknowledge your complaint within 48 hours of its receipt.

The Academy is committed to responding to your complaint, queries about refund and/or cancellation of products, and/or services within 14 days, but general queries relating to the Agreement may take longer. The Academy is committed to responding to your request relating to the Privacy Policy within 45 days.
